Moonsense Terms of Service

Thank you for using Moonsense. These Terms of Service ("Terms") govern your access to and use of the Moonsense mobile application (the "App"). By using the App, you agree to these Terms.

If you do not agree, please do not use the App.

1. What Moonsense Does

Moonsense is a mindfulness and journaling app that provides lunar insights, local moonrise/set times, approximate lunar zodiac information, personalized prompts and affirmations, optional AI-generated insights from your journal entries, and daily horoscopes.

• • Journal entries are stored locally on your device using Apple’s on-device storage technologies.
• • Moon phase, moonrise/set, and lunar zodiac are calculated locally on-device (no external API is used for these core features).
• • Daily horoscopes are fetched from a third-party, free API by sending your selected zodiac sign.
• • Optional AI features use Google’s Generative Language API (Gemini) to generate personalized content based on limited data you provide.
• • Premium features are available via subscriptions processed by Apple’s App Store.

2. Eligibility

• • You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App.
• • If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian’s permission.

3. No Accounts; Your Data Stays Local

Moonsense does not require an account and does not operate its own cloud servers. Most app data (including your journal content, name, focus, birth timestamp, location coordinates saved during onboarding, zodiac sign, notification preferences, and related settings) is stored locally on your device.

4. Your Content and License

You own the content you create in the App.

By using optional AI features, you grant Moonsense a limited, revocable license to transmit only the data necessary (e.g., your first name, selected focus, current lunar sign, limited snippets or derived themes from recent entries) to Google’s Generative Language API (Gemini) to generate the requested output for you. Moonsense does not store your content on Moonsense servers.

You represent and warrant that you have the right to submit the content and that it does not violate applicable laws or third-party rights.

5. AI Features and Third-Party Services

• • Google Generative Language API (Gemini): When you request AI-generated insights, Moonsense sends a carefully scoped prompt that can include up to ~200 characters from up to 20 recent journal entries (for insights), plus your first name, current moon phase and lunar sign, and selected focus. For personalized affirmations and reflection prompts, Moonsense sends derived themes (keywords) from up to 5 recent entries rather than full text. Responses are returned to your device.
• • Horoscope API (Vercel-hosted): The App requests a daily horoscope by sending your selected zodiac sign. No other personal data is sent for this feature.
• • Apple Services: Purchases and subscriptions are processed by Apple. Moonsense uses StoreKit to verify entitlements and the App Store review prompt framework.

Each third-party service has its own terms and privacy policies, which you should review. Moonsense is not responsible for third-party services.

6. Subscriptions and Billing

Moonsense Premium is offered via auto-renewing subscriptions (Monthly and Yearly). Pricing is shown in the App and may vary by region.

• • Payment is charged to your Apple ID at confirmation of purchase.
• • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
• • Manage or cancel subscriptions in your device’s App Store account settings.
• • Refunds are handled by Apple per App Store policies. Moonsense does not issue direct refunds.

If pricing changes, the new price will be displayed in the App Store and/or in-app. Continued use after a price change constitutes acceptance of the new price for subsequent billing periods.

7. Acceptable Use

You agree not to:

• • Use the App in violation of any law or regulation.
• • Submit unlawful, infringing, harmful, or misleading content.
• • Attempt to reverse engineer, circumvent, or disable security or protections, including paywalls.
• • Use the App to collect or process sensitive personal data of others without lawful basis.

Moonsense may suspend or terminate your access for violations of these Terms.

8. Wellness and Entertainment; No Medical Advice

Moonsense provides mindfulness and spiritual/astrological content for personal reflection and entertainment. The App does not provide medical, psychological, financial, or legal advice. Do not rely on the App for decisions that have professional or clinical implications. If you need such advice, consult a qualified professional.

9. Intellectual Property

The App and all associated content, visuals, designs, text, and code (excluding your content) are owned by the Moonsense developer and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App except as permitted by these Terms and applicable law.

10. Disclaimers

The App is provided “as is” and “as available.” To the maximum extent permitted by law, Moonsense disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Lunar calculations are approximate and intended for personal use; AI outputs and horoscopes are generated/obtained from third parties and may contain inaccuracies.

11. Limitation of Liability

To the maximum extent permitted by law, Moonsense will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses, arising from or related to your use of the App. In jurisdictions that do not allow certain limitations, liability is limited to the fullest extent permitted by law.

12. Changes to the App and Terms

Moonsense may update the App and these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of California, USA, without regard to conflict of law principles. If you are a consumer in the EEA/UK, you may benefit from mandatory consumer protections of your country of residence.
